Terms of Service

Section 01

Introduction

1.1 Definitions

manukmiberAI (hereinafter referred to as the "Service") is a subscription-based AI proxy service designed exclusively for AI Roleplay (AI RP) purposes. This Service is provided by manukmiber (hereinafter referred to as the "Provider").

1.2 Acceptance of Terms

By accessing, registering, or using this Service, you (hereinafter referred to as the "User") agree to be bound by these Terms of Service. If you do not agree to these terms, please immediately stop using the Service.

1.3 Changes to Terms

The Provider reserves the right to modify these Terms of Service at any time. Changes will be notified at least 2 (two) weeks before the 1st of the following month via email or dashboard notification. Continued use of the Service after changes take effect means you accept the new terms.

Section 02

User Eligibility

2.1 Age Requirement

You must be at least 18 (eighteen) years old to use this Service.

2.2 Age Verification

Age verification is conducted through a checkbox mechanism ("I am 18+"). By checking this box, you legally declare that you meet the minimum age requirement in your jurisdiction.

2.3 Legal Representation

You are fully responsible for compliance with local laws in your country regarding adult content (NSFW/NSFL) that you may access through this Service.

Section 03

Account & Security

3.1 Account Registration

• Each user will receive a unique API Key automatically after subscription.
• API Key is a secret credential that must not be shared with others.

3.2 IP Address Limit

• Each API Key can be used from a maximum of 3 (three) different IP Addresses.
• If more than 3 IP Addresses are detected, the account may be suspended for investigation.

3.3 VPN/Worker/Forwarder Prohibition

• Use of VPN, Worker, Forwarder, or IP masking tools will be detected as a violation.
• Each detection will result in 1 (one) Strike on your account.
• We apply Strict Liability - unintentional use (e.g., VPN active in background) does not exempt you from strike, but can be appealed (see Section 7).

3.4 API Key Leakage

• If your API Key leaks and is used by others to violate rules, you remain responsible as the account owner.
• If abnormal traffic spikes or drops are detected, the account will be temporarily suspended and you must contact us for clarification.

Section 04

Acceptable Use Policy

4.1 Permitted Use

This Service may ONLY be used for:

• Connection to AI Roleplay websites that we have authorized.
• Generating text content for Roleplay purposes.

4.2 Prohibited Use (Strike System)

The following violations will result in a Strike on your account:

Attempting to bypass detection system	1 Strike

4.3 Prohibited Use (PERMANENT BAN)

The following violations will result in PERMANENT BAN immediately without strike system:

Use for Daily Use / General Q&A	PERMANENT BAN
Use on websites that allow Reverse Proxy	PERMANENT BAN
Attempting to exploit Service infrastructure	PERMANENT BAN

4.4 Content Policy

• Users are allowed to generate NSFW/NSFL content for Roleplay purposes.
• Users are prohibited from generating content that is illegal under international law, including but not limited to:
  • CSAM (Child Sexual Abuse Material)
  • Content involving minors in sexual situations
  • Promotion of terrorism or real criminal acts
• Provider does not filter content beyond usage detection (RP vs Non-RP).
• Content responsibility lies entirely with the User.

Section 05

Strike System & Penalties

5.1 Strike Calculation

• Each violation (Section 4.2) will be recorded as 1 Strike.
• Strikes are PERMANENT and do not expire.
• Strikes accumulate for the lifetime of the account.

5.2 Penalty Stages

4 Strikes	Final Warning
5 Strikes	Permanent Ban without refund

5.3 Immediate Permanent Ban

For violations in Section 4.3, accounts may be blocked permanently without waiting for strike accumulation.

Section 06

Subscription & Payment

6.1 Subscription Model

• Service operates on a subscription-based model.
• Payment is made in advance for the selected period.

6.2 Refund Policy

• No refund for change of mind.
• No refund if account is blocked due to Terms of Service violation.
• Remaining subscription period is forfeited if account is terminated due to violation.

6.3 Price Changes

• Provider will notify price changes at least 2 (two) weeks before the 1st of the following month.
• New prices apply to the next renewal period.

6.4 Payment Failure

• If automatic payment fails, you have a Grace Period of 3 (three) days.
• After grace period ends, account will be downgraded to free version (if available) or access limited.

6.5 Taxes

• Displayed prices do not include taxes.
• Users are responsible for digital taxes applicable in their respective countries.
• Taxes will be processed through Payment Gateway as Merchant of Record (MOR).

6.6 Downtime Compensation

• If Service experiences total downtime caused by Provider error, Users will receive 10% discount for the next subscription period.
• Downtime caused by force majeure (DDoS attacks, natural disasters, etc.) is not eligible for compensation.

Section 07

Appeal Process

7.1 Right to Appeal

• Every blocked account (whether through strike system or permanent ban) has the right to appeal.
• Appeal must be submitted within 7 (seven) days after the ban date.

7.2 Appeal Process

• Appeals are submitted via email to: support@manukmiber.biz.id
• Provider will review appeals as quickly as possible.
• If appeal is accepted and violation is proven unintentional, penalty may be reduced from Ban to Strike.

7.3 Appeal Abuse

• If proven to submit appeals with false or baseless reasons (frivolous appeal), account will be PERMANENTLY BANNED without possibility of re-appeal.

Section 08

Privacy & Data

8.1 Collected Data

We collect and store the following data:

• IP Address
• API Key
• Email Address

8.2 Data NOT Stored

• We do NOT store chat/conversation logs permanently.
• Content is sent to self-hosted AI model for checking, then immediately purged (deleted).

8.3 Metric Data (Aggregated)

We store the following metric data for trends and statistics:

• Input Token Count
• Output Token Count
• Reasoning Token Count
• Model Used
• Cost Incurred

This metric data is aggregated with thousands of other users' database and cannot be deleted per individual.

8.4 Data Deletion Rights

• Users can request account deletion (IP, API Key, Email).
• Metric data that has been aggregated cannot be deleted as it is part of anonymous statistics.
• By using the Service, you agree that aggregated data cannot be deleted per individual request.

8.5 Global Compliance

• For users from European Union (GDPR) and California (CCPA), your privacy rights are respected within technical limitations explained above.
• We do not sell personal data to third parties.

Section 09

Intellectual Property

9.1 Service Ownership

All rights to the Service, including code, design, infrastructure, and API, belong to manukmiber.

9.2 Output Ownership

• Users own the rights to text generated through the Service.
• However, storage and ownership of output data depends on the third-party AI RP website you use (e.g., janitor.ai stores data on their servers).
• manukmiberAI does not store copies of your output.

9.3 Reverse Engineering Prohibition

Reverse engineering, decompilation, or attempting to access Service source code is prohibited.

Section 10

Third Parties

10.1 AI RP Websites

• This Service functions only as a proxy/access provider.
• We are not responsible if your account on third-party AI RP websites (e.g., janitor.ai, character.ai, etc.) is blocked or banned.
• We have no control over third-party website policies.

10.2 Payment Gateway

• Payments are processed through third-party Payment Gateway as Merchant of Record (MOR).
• Refund and payment dispute policies follow the Payment Gateway's terms.

Section 11

Disclaimer

11.1 Service "As Is"

Service is provided "As Is" without any warranty, express or implied.

11.2 Limitation of Liability

Provider is not responsible for:

• Losses due to Roleplay data loss
• Access to blocked third-party accounts
• Business losses or other indirect damages
• Service interruptions due to force majeure

11.3 Service Availability

We do not guarantee that the Service will be free from errors, interruptions, or downtime.

Section 12

Reselling Prohibition

12.1 Resale Prohibited

• Users are prohibited from reselling access to this Service to others.
• Sharing API Key for commercial purposes is prohibited.

12.2 Custom Pricing

• For business or individual needs requiring large-scale access, please contact us at support@manukmiber.biz.id for custom pricing offers.

Section 13

Service Termination

13.1 By User

Users can cancel subscription at any time through dashboard. No refund for remaining period.

13.2 By Provider

Provider reserves the right to terminate User access at any time if:

• Terms of Service violation is detected
• Required by applicable law
• Service is permanently discontinued (with 30 days notice)

Section 14

Governing Law & Disputes

14.1 Governing Law

These Terms of Service are governed by the laws of the Republic of Indonesia.

14.2 Jurisdiction

All disputes arising from use of this Service will be resolved through competent courts in Indonesia.

14.3 Class Action Waiver

Users agree not to participate in class action lawsuits against the Provider.

14.4 Dispute Resolution

Parties agree to resolve disputes through negotiation first. If no agreement is reached, matters will be resolved through applicable legal channels.

Section 15

Additional Clauses for Global Users

15.1 Local Law Compliance

Users outside Indonesia are responsible for complying with applicable laws in their respective countries regarding:

• Adult content (NSFW/NSFL)
• Use of proxy services
• Digital taxes

15.2 Geographic Restrictions

This Service is available globally, except for countries that explicitly prohibit access to such services.

15.3 Language

This English version is provided for convenience. In case of discrepancy with the Indonesian version, the Indonesian version shall prevail.
